Childhood obesity is in important respects a result of legal policies that influence both dietary intake and physical activity. The law must shift focus away from individual risk factors alone and seek instead to promote situational and environmental influences that create an atmosphere conducive to health. To attain this goal, advocates should embrace a population-wide model of public health, and policymakers must critically examine the fashionable rhetoric of consumer choice.

BEGINNING with G. E. M. Anscombe's "Modern Moral Philosophy" in 1958, various critics--e.g., Frankena, Foot, MacIntyre, and Murdock--have, to one extent or another, expressed dissatisfaction with the condition of modern moral philosophy. Prior to this round of critiques, H. A. Prichard in 1912 asked the question "Is Moral Philosophy Based on a Mistake?" in an essay of that title in Mind. One finds precedent for these expressions of discontent with the ground rules of moral philosophy in both Aristotle and Kant, (...) two thinkers whose reformulations of the questions and procedures of ethics proved seminal for the discipline. Even neglecting other important developments in contemporary moral philosophy, the diversity and rigour of these critiques alone suggest that the prognosis for the discipline of ethics is quite favorable. Philosophy in at least one of its dimensions has recovered that self-reflective attentiveness that marks its most productive phases. So it is that several of these contemporary critiques raise the suspicion that what is wrong with moral philosophy is that it operates outside of a context in terms of which talk about moral laws or moral goods would be intelligible. Our contemporary situation can thus be contrasted with, for example, that of Aristotle for whom a discussion of "magnificence" was firmly rooted in an Athenian context in terms of which an argument over the merits of that particular virtue might be resolved. Alasdair MacIntyre's After Virtue brings this line of reflection into sharp new focus with a series of illuminating discussions concerning the role of the virtues both in the history of moral practices and in the logic of moral argument. In general, MacIntyre tries to show that "contemporary moral debate is interminable" ; that is, he tries to show why, given the nature of contemporary moral philosophy, there is "no rational way of securing moral agreement". Because I believe MacIntyre is successful in his demonstration, I shall, in this paper, take that demonstration for granted and try to construct a set of arguments designed to show how, in terms of a universally accessible paradigmatic character, we have at hand a way of avoiding the "interminable" regress of moral debate. Thus although my argument is derivative to MacIntyre's diagnosis and dependent, in part, upon his treatment of the concept of virtue, the proposal I develop here for the resolution of moral arguments is, sadly to say, somewhat at odds with his own. Individuals with major depressive disorder (MDD) often ruminate about past experiences, especially those with negative content. These repetitive thoughts may interfere with cognitive processes related to attention and conflict monitoring. However, the temporal nature of these processes as reflected in event-related potentials (ERPs) has not been well-described. We examined behavioral and ERP indices of conflict monitoring during a modified flanker task and the allocation of attention during an attentional blink (AB) task in 33 individuals with MDD and 36 healthy controls, (...) and whether their behavioral performance and ERPs varied with level of rumination. N2 amplitude elicited by the flanker task was significantly reduced in participants with MDD compared to healthy controls. Level of self-reported rumination was also correlated with N2 amplitude. In contrast, P3 amplitude during the AB task was not significantly different between groups, nor was it correlated with rumination. No significant differences were found in behavioral task performance measures between groups or by rumination levels. These findings suggest that rumination in MDD is associated with select deficits in cognitive control, particularly related to conflict monitoring. (shrink)

However, ethical issues may arise when physicians appear on behalf of the tobacco industry. Two ways that doctors participate in lawsuits are through depositions and by testifying in court during trial. The Tobacco Deposition and Trial Testimony Archive is an electronic database of depositions, trial testimony, opening and closing statements, and other material from tobacco lawsuits collected by the (...) Center for Tobacco Use Prevention and Research. At the time the research for this article was conducted, the database included depositions and trial testimony of expert witnesses from 232 smoking and health cases. (shrink)

An impressive body of recent literature posits that traditional notions of civil disobedience prevent us from properly considering potentially legitimate types of ‘uncivil’ political lawbreaking. When might uncivil (covert, legally evasive, morally offensive and potentially violent) lawbreaking prove normatively acceptable? If justifiable, what conditions should its practitioners be reasonably expected to meet? Despite some important insights, defenders of uncivil disobedience rely on a narrow and sometimes misleading view of civil disobedience, as previously practiced and theorized. Notwithstanding legitimate skepticism about Rawlsian (...) notions of civil disobedience, they reproduce its troublesome binary or ‘all-or-nothing’ view of political lawbreaking. Uncivil disobedience’s proponents tend to group a vast array of distinctive types of lawbreaking under one amorphous categorical rubric, impeding the suitably complex, nuanced analysis we need. A superior approach would pay careful attention to uncivil disobedience’s ambivalent historical record, a record suggesting that UD is more likely to reproduce authoritarian populism’s disturbing political logic than counteract it. This book analyzes the support that should be given to minority views, reconsidering classic debates in Science and Technology Studies and examining numerous case studies.

Taking reduction in the traditional deductive sense, the programmatic claim that most of genetics can be reduced by molecular genetics is defended as feasible and significant. Arguments by Ruse and Hull that either the relationship is replacement or at best a weaker form of reduction are shown to rest on a mixture of historical and logical confusions about the nature of the theories involved.

We argue elsewhere that explanatoriness is evidentially irrelevant . Let H be some hypothesis, O some observation, and E the proposition that H would explain O if H and O were true. Then O screens-off E from H: Pr = Pr. This thesis, hereafter “SOT” , is defended by appeal to a representative case. The case concerns smoking and lung cancer. McCain and Poston grant that SOT holds in cases, like our case concerning smoking and lung cancer, that involve frequency (...) data. However, McCain and Poston contend that there is a wider sense of evidential relevance—wider than the sense at play in SOT—on which explanatoriness is evidentially relevant even in cases involving frequency data. This is their main point, but they also contend that SOT does not hold in certain cases not involving frequency data. We reply to each of these points and conclude with some general remarks on screening-off as a test of evidential relevance. (shrink)

This work explores the hypothesis that natural language is a tool for changing a language user's state of mind and, more specifically, the hypothesis that a sentence's meaning is constituted by its characteristic role in fulfilling this purpose. This view contrasts with the dominant approach to semantics due to Frege, Tarski and others' work on artificial languages: language is first and foremost a tool for representing the world. Adapted to natural language by Davidson, Lewis, Montague, et. al. this dominant approach (...) has crystalized as truth-conditional semantics: to know the meaning of a sentence is to know the conditions under which that sentence is true. Chapter 1 details the animating ideas of my alternative approach and shows that the representational function of language can be understood in terms of the more general function of changing representational mental states. Chapters 2-4 argue that the additional resources of this more general conception of meaning allow us to explain certain phenomena involving conditionals and grammatical mood that truth-conditional semantics does not. In the analysis of these specific phenomena and the articulation of the general approach on offer, it emerges that this approach combines insights and benefits from both use-theoretic and truth-theoretic work on meaning. As a clinical geneticist I have been amazed at the speed of discovery over the past 20 years. The specific genetic causes of thousands of rare genetic conditions have been defined due to improvements in genomic sequencing, computing power and international collaborations to phenotype individuals with similar clinical features. This knowledge has resulted in an increased ability to make accurate molecular diagnoses which informs optimal treatment and clinical care, can remove the need for unnecessary investigations and informs reproductive decision-making. However (...) for any given individual, this genetic testing can often take weeks or months before the initial genetic diagnosis is made within a family. Occasionally genetic information is required more quickly to define a clinical action. For years point of care testing (POCT) has been a mainstay of clinical care, for example, in confirming pregnancy or monitoring blood glucose. I had been keen to explore scenarios where a genetic POCT could be employed in clinical practice. To me, an obvious example appeared to be neonatal testing to avoid gentamicin-induced hearing loss.
